第1条  適用範囲

1. Scope of Application

本規約は、本サービスの利用に関し、タグボートとお客様との間に適用されるものとし、お客様は、サービスを利用するにあたり、本規約を誠実に遵守するものとします。
タグボートが別途本サービス上における掲示またはその他の方法により規定する個別規定およびタグボートが随時お客様に対し通知する追加規定は、本規約の一部を構成します。本規約と個別規約および追加規定が異なる場合には、個別規定および追加規定が優先するものとします。

By using our Site, these Terms shall be applied between you and TAGBOAT, and you shall comply with these Terms in good faith. Any individual terms separately stipulated by TAGBOAT through notifications on the Site or any other means, and any additional terms we may notify to you from time to time shall constitute a part of these terms. If these Terms differ from the individual terms and additional provisions, the individual provisions and additional provisions shall prevail.

第2条  お客様情報登録

2. Registration

お客様は、本サービスを利用してタグボートより商品またはサービス(以下「商品」という)を購入することができます。
お客様は、商品の購入を希望する場合、タグボートが指定する方法に従って申し込むものとします。お客様は、申込み内容につき真実かつ正確なデータを送信するものとします。
オンライン申込によりタグボートに送信されたお申込の内容に間違いがあった場合、タグボートは、タグボートの責に帰すべき場合を除き、「返品」に定める返品以外のお客様のいかなるお申し出にも応じかねますので、あらかじめご承知ください。
お客様は、住所、氏名、電話番号又はその他タグボートに届出ている事項に変更が生じた場合には、すみやかに届出るものとします。

You can use our Site to purchase goods or services ("goods") from TAGBOAT.
A prospective purchaser (“Buyers”) shall apply according to the method specified by TAGBOAT. You shall enter truthful and accurate data on your application. If there is an error in the application sent to TAGBOAT by online application, we will not accept any request from you other than the return specified in "Return Policy" unless it is our responsibility.
You are responsible to promptly notify any changes to your address, name, telephone number or other information provided to TAGBOAT.

第3条  申込みの制限

3. Application Restriction

未成年者のお客様は、法定代理人の同意を得たうえで、法定代理人のご名義で商品のお申込を行ってください。また、その他制限行為能力者のお客様は、必要な同意等を得てください。

If you are a minor, you are responsible to obtain the consent of legal representative before applying for the goods in the name of the legal representative. Buyers with other restricted ability should also obtain the necessary consent.

第4条  利用者情報について

4. User Information

本サービスの利用に関連して当社が知り得た利用者の個人情報については、弊社、プライバシーポリシーに準じて取扱いを行ないます。

We handle your personal information in relation with the use of our Site, in accordance with our privacy policy.

第5条  売買契約の成立

5. Conclusion of Sales Contract

第2条における申込みに対して、タグボートが承諾する場合、タグボートカスタマーセンターより購入のご契約が成立した旨を、お客様が記入あるいは申請した電子メールアドレスをもって発信しますので、お客様はこれを確認するものとします。電子メールが到達した時点で、お客様とタグボートとの間に本サービスに関する停止条件付売買契約が成立するものとします。
前項の規定に拘らず、本サービス利用に関して不正行為もしくは不適切な行為があった場合、またはお客様指定のクレジットカード会社等から与信不履行等の旨の連絡があった場合、タグボートは、売買契約を取消もしくは解除、履行停止その他適切な措置を取ることができるものとします。

If TAGBOAT approves the application in 2. Registration, our customer center will inform you the completion of purchase contract with the e-mail address you filled out or applied for, followed by your confirmation. Upon arrival of this e-mail, a conditional sales contract regarding our service shall be concluded between you and TAGBOAT. Notwithstanding the provisions of the preceding paragraph, if there is any fraudulent or inappropriate act regarding the use of the Site, or if we are notified by your designated credit card company that there has been a credit default, TAGBOAT reserve the right to cancel, terminate or suspend the sales contract and take other appropriate measures.

第6条  所有権の移転

6. Transfer of Ownership

お客様またはその指定納入先が、お申込された商品を受領した時点をもって、当該商品の所有権はタグボートからお客様に移転するものとします。
クレジットカードによるお支払いをご選択された場合、クレジットカード会社の定める会員規約、または利用条件に従い、お申込にかかる商品の所有権がクレジットカード会社に留保される場合がございます。詳しくはクレジットカード会社の会員規約またはクレジット契約の内容をご確認ください。

From the moment the customer or the designated delivery destination receives the applied goods, its ownership shall be transferred from TAGBOAT to the customer. If you choose to pay by credit card, the credit card company may retain ownership of the goods you are applying for in accordance with the membership terms or terms of use set by the credit card company. For details, please read the membership terms of the credit card company or the contents of the credit contract.

第7条  商品の提供時期

7. Time of the Delivery

商品の提供時期とは、商品ごとに記載するお届け期間によるものですが、記載されている期間はあくまでも目安となります。
※銀行振込でのお支払いの場合は、タグボートからのご入金確認メール送信後から作品提供期間が開始いたします。
まれに供給元からの予期せぬ供給変動により、ご注文品が入手できない場合や、サイト上に記載されている当初の発送可能時期から前後する場合もございますが、その際は別途メールにてご連絡申し上げます。
ただし、離島などへの配送はお電話もしくはメールにてご相談の上、配達日時を決定させていただきます。
また、天災・交通事情・その他の事情により指定の時間帯にお届けできない場合がございます。なお、配送会社の事由による配送遅延に伴ういかなる損害についてもタグボートは一切の責任を負いません。予めご了承ください。

The time of delivery depends on the delivery period stated for each goods, but the stated period is only an estimate.
* If the payment is made by bank transfer, provision period of works will begin after we send you the payment confirmation email. In rare cases, due to unexpected supply fluctuations from the supplier, the ordered goods may not be available, or it may be before or after the initial shipping time stated on the site, in which case we will contact you by e-mail separately. However, for delivery to remote islands, we will decide the delivery date and time after consulting with you by phone or e-mail. In addition, delivery may not be possible at the designated time due to natural disasters, traffic conditions, or other circumstances. Please note that TAGBOAT do not take any responsibility for any damage caused by delivery delay due to the reason of the delivery company.

第8条  返品

8. Return Policy

・お客さまのご都合による返品・交換、またはお客さまの責任により、キズ・汚損が生じた場合、

返品をお受け出来ません。
・万一、配送中の破損・不良・商品間違いのある場合は、商品到着後1週間以内に
　customer.tagboat@tagboat.comまでご連絡ください。
　状況を確認の上、速やかに対応させていただきます。なお送料は弊社で負担いたします。

なお、返品の場合のお支払い済みの代金に関しまして、作品の破損・誤送の場合は、返金方法をご連絡の上、返金させていただきます。

・ We do not accept returns or replacement of goods due to customer's convenience, or we do not accept returns if damages or stains occur due to customer's responsibility.

・ In the unfortunate event that your order arrives in less than satisfactory condition such as damaged and defective during delivery, or incorrect goods, you must report the issue within one week of delivery at customer.tagboat@tagboat.com
After confirming the situation, we will correspond promptly. We will cover the shipping cost.

For the payment that has been already completed in regards to returns, if the work is damaged or delivered incorrectly, we will refund after informing you the refund method.

第9条  変更・キャンセル

9. Changes and Cancellation Policy

ご注文を頂きましてから、24時間以内であれば変更・キャンセルをお受け致します。
以降にご連絡頂いた場合には、発注作業に入っている為、キャンセルはお受け出来ません。

If for any reason you are not satisfied with your purchase, you may change or cancel within 24 hours of receiving your order. It is important to note that if you contact us after that, we will not accept cancellation as we are in the process of placing an order.

第10条  商品の引渡し

10. Delivery of Goods

お申込いただいた商品は、タグボートが指定する配送業者による配送便にてお届けいたします。
<配送会社例:ヤマト運輸/大宝運輸/西濃運輸/パックメール　等>

商品をダンボールや専用ケース等で保護し、梱包材(エアキャップ)を巻きつけ、破損などが起きないよう十分配慮した上で、お届けいたします。
また、原則として作品の配送先は、お客様情報記入ページにて、お客様が登録されたご住所となります。商品は発送から一週間以内にお受け取りください。期間内にお受け取りいただけない場合、その他お客様の都合でお届けが出来ない場合は、キャンセル扱いとさせていただき、タグボートはその際の配送料および保管料を申し受けることができるものとします。

The purchased goods are delivered to you by the carrier specified by TAGBOAT.

We will protect the goods with cardboard or a special case, wrap it with packing material (inflatable cushion), and deliver after careful consideration to prevent damage. In principle, the delivery address will be the address registered by you on the customer registration page.　You are responsible to receive the goods within one week of delivery. If you do not receive it within the period or if it cannot be delivered due to your convenience, it will be treated as a cancellation and TAGBOAT have the right to charge you the shipping and storage cost.

第11条  代金の支払方法および支払時期

11. Payment Methods and Period

本サービスの商品価格には、消費税および地方消費税(以下、「消費税等」といいます)が含まれております。
本サービスの決済方法は、 お申込単位毎に、次の(1)(2)のいずれかの方法を選択することができます。

(1)クレジットカード
お客様のお名前とカードの名義人は同一である必要があります。
ご利用にあたって、クレジットカードの種別、名義人名、番号、有効期限、をタグボートの指示に従って情報記入ページでご入力いただくことが必要となります。
ご利用可能なクレジットカードは、JCB、VISA、Master、AMERICAN EXPRESS、Diners Clubです。
お客様による商品代金のお支払いは、各クレジットカード会社の会員規約にもとづくお支払いとなります。なお、お客様のクレジットカードへのご請求は、ご注文が確定された段階においてなされます。

<ご選択可能な支払い方法種別>
一括払い
なお、クレジットカードによる支払い方法をご希望される場合であっても、クレジットカード会社によるクレジットカード利用の承認が得られない場合には、お申込をお断りいたしますので、あらかじめご了承ください。この場合、他の支払方法をご利用ください。

(2) 銀行振込
商品の代金は、ご購入のお申し込み手続き後、カスタマーセンターから送られる振込み自動注文受付メールに記載された指定する銀行口座に、4金融営業日以内に電信扱いにてお振り込みください。ご入金が確認できましたら、入金確認のメールをお送りさせて頂きます。4営業日以内にお客様からの商品代金のご入金が確認できない場合はキャンセル扱いとさせていただく場合がございます。
なお振込手数料はお客様がご負担ください。お申込者のお名前と振込人名義は同一である必要があります。。(※万一、お申込者と振込人名義が異なる場合には、ご入金確認ができませんので、 ご購入後、又はお振込み後にご連絡ください。) お申込内容送信後、画面上に表示される購入番号を必ず控えておいてください。
4営業日以内にお客様からの商品代金のご入金が確認できない場合はキャンセル扱いとさせていただく場合がございます。

The product price of our service includes consumption and local consumption tax. We accept one of the following payments for each application unit.

(1) Credit card
Buyer must enter card type, cardholder name, card number and expiration date on the information page under instructions. We accept JCB, VISA, MasterCard American Express and Diners Club. Buyer shall pay according to the membership terms of the credit card company and is charged upon purchase confirmation.

Single payment
We will refuse your application if the credit card company restrict its use, even if you wish to pay by credit card. Please use another payment.

(2) Bank transfer
After completing purchase application, buyer must wire transfer within 4 business days to the designated bank account stated in the automatic order email from customer center. Once payment is confirmed, a confirmation email is sent to you. If we cannot confirm payment within 4 business days, we may cancel your order.

第12条  禁止事項

12. Prohibited Uses

お客様は、以下の行為を行ってはならないものとします。
ご利用の際に虚偽の内容を入力あるいは登録申請する行為
本サービスの運営を妨げ、その他本サービスに支障をきたすおそれのある行為
クレジットカードを不正使用して本サービスを利用する行為
他の利用者、第三者もしくは弊社に迷惑、不利益、もしくは損害を与える行為、またはそれらのおそれのある行為
他の利用者、第三者もしくは弊社の著作権等の知的財産、プライバシー・人格権その他の権利を侵害する行為、またはそれらのおそれのある行為
公序良俗に反する行為その他法令に違反する行為、またはそれらのおそれのある行為
その他、タグボートが不適当と判断する行為

TAGBOAT prohibits you from performing the following acts;
Entering false contents while using our Site or applying for registration.
Interfere with our operation or attempt to interfere with our service.
Use our service by illegally using a credit card.
Cause inconvenience, disadvantage, or harm other users, third parties, our company, or actions that may cause them.
Infringe or may infringe on intellectual property such as copyrights of other users, third parties or our company, privacy, moral rights and other rights.
Violate public order and morals or other acts that violate laws and regulations, or acts that may cause them.
Other acts that TAGBOAT deems inappropriate.

第13条  転売について

13. Resale Conditions

お客様が、本サービスでご購入されたタグボート・アーティスト(※注1)の作品をお客様の手元または指定納入先に到着した時点から起算して3年以内に第三者へ転売することを禁止いたします。

また、フリマサイト、フリマアプリ、美術を専門としないネットオークションなどでの二次販売を禁じます。
購入から3年後以降に二次販売をされる場合は、必ず美術品を専門的に取り扱うオークションハウスか、株式会社タグボートを経由で販売をしてください。


(※注1)タグボート・アーティストとは、タグボートが直接取引をしているアーティストであり、以下のタグボート・アーティストの一覧に表示されている作品を作品を指す。

We prohibit the buyer from reselling tagboat artist's (*) artwork purchased through our service to a third party within three (3) year from delivery to you or to your designated delivery destination.

Secondary sales on flea market sites, flea market applications, and online auctions that do not specialize in art are prohibited. If you wish to conduct a secondary sale after three years from purchase, please be sure to sell through an auction house specializing in fine art or TAGBOAT.

tagboat Artists are artists with whom Tugboat has direct dealings and whose works appear in the following list of tagboat Artists.

第14条  著作権

14. Copyright

本サービス内のコンテンツ(情報・資料・画像・音声等)の著作権は、個別に特段の明示がない限りタグボートが保有しており、日本国著作権法および国際条約により保護されています。営利、非営利を問わず、法律上許容される範囲を超えて本サービス内のコンテンツ(情報・資料・映像・音声等)を複製、転用、販売などを行い、あるいは、コンテンツの内容を変形、変更、加筆修正、翻案などを行うことは、個別にタグボートの文書による事前の合意がない限り一切認められておりません。
サービスで使用しているロゴはタグボートの商標ですので、タグボートへの事前のご連絡および許諾なき限り、使用できません。

Unless otherwise specified, the copyright of our service content (information, materials, images, audio, etc.) is owned by TAGBOAT and is protected by Japanese copyright law and international treaties. Without the prior written individual agreement from TAGBOAT, regardless of commercial or non-commercial purpose, you are not permitted to use our service content (information, materials, video, audio, etc.) in any way beyond the legally permissible range to reproduce, divert, sell or transform, modify correct, adapt etc. our service content. The logo used in our service is a trademark of TAGBOAT and cannot be used without prior notice and permission from TAGBOAT.

第15条  サービスの一時中止

15. Temporary service suspension

タグボートは、天災などの緊急事態または本サービスの稼動状況を良好に保つために、定期的メンテナンス若しくはリニューアル等サービス運営上の都合により、お客様に対して何ら通知を行うことなく、本サービスの提供の全部あるいは一部を中止することがあります。
またサービスの停止または欠陥およびこれらに起因して発生する損失や損害について、一切責任を負いません。

Emergencies such as natural disaster or to maintain good operating conditions, TAGBOAT may cancel all or part of our service without any notice to you by the convenience of service operation such as regular maintenance or renewal. In addition, we are not responsible for any service interruption or defect and any loss or damage caused by the above.　

第16条  サービス内容の変更・終了

16. Changes and Termination of Service

タグボートは、お客様に対し何ら通知を行うことなく　本サービスの内容または機能の全部または一部を変更、追加または終了することがあります。

TAGBOAT reserves the right to modify, add or terminate all or part of our service contents or functions without notice to you.

第17条  免責および保証の否認

17. Disclaimer and Warranty Repudiation

タグボートは、本サービス上に掲示される情報の正確性、合法性、道徳性、最新性、適切性、合目的性などその内容について、お客様に対して、明示的又は黙示的な保証を行いません。
また、タグボートは、お客様による本サービスの利用に起因又は関連して利用者が破る一切の損害について、責任を負いません。

TAGBOAT do not make explicit or implied warrant to you regarding the accuracy, legality, morality, recency, suitability, purposiveness etc. of the information posted on our Site. In addition, we shall not be liable for any damages caused or related to the use of our service by the user.

第18条  セキュリティーポリシー

18. Security Policy

タグボートは、お客様が本サービスのご利用にあたり入力、送信した個人情報については、暗号化処理等を行い、厳重に管理し機密保持に十分な注意を払いますが、情報の漏洩、消失、他者による改ざん等の防止の保証は致しかねます。

TAGBOAT use security measures such as encryption, pay careful attention to confidentiality and strictly manage your personal information entered and transmitted when using our site, however, we do not warrant the leakage and loss of information, prevention of falsification by third parties etc.

第19条  本規約の変更

19. Modifications

この利用規約は、お客様への予告なく変更されることがあります。各ウェブページにて変更の案内があった場合には、必ず内容のご確認をお願いします。ただし、この利用規約の変更前にお申込された商品の売買につきましては、変更前の利用規約が適用されます。

We may modify these term of use without notice to you. Please make sure to check the contents when there is a notice of change informed on each web pages. However, the purchase and sale of goods before the modification applies the term of use before such change.

第20条  その他

20. Other

商品の色調は、パソコンのモニター画面でご覧いただく都合上、現品と多少の違いがある場合もございますので、あらかじめご了承ください。
本サービスを提供する機器の故障およびトラブルならびに通信回線の障害等により、お客様のデータが消失等した場合、タグボートは何ら通知をせず、売買契約を取消または解除する場合がございます。

Please note that the color tone of the product may differ slightly from the actual product due to the viewing convenience on the monitor screen of your computer.
If your data is lost due to a malfunction or trouble of the equipment that provides our service or a failure of the communication line, TAGBOAT may cancel or terminate the sales contract without any notice to you.

第21条  準拠法および管轄

21. Governing Law and Jurisdiction

本規約は、日本法を準拠法といたします。 本サービスに関連してお客様とタグボートの間で訴訟の必要が生じた場合、訴額に応じて東京簡易裁判所または東京地方裁判所を合意管轄裁判所といたします。

These terms shall be governed by the law of Japan. If there is a need for a proceeding between you and TAGBOAT in relation with our service, the Tokyo Summary Court or the Tokyo District Court will be the court of jurisdiction depending on the amount of the proceeding.
